You were referring to libel and slander, just because I've pointed out you referred to people as "bandits" and that nobody pursues slander cases anymore because payouts are very low, you've changed your argument to now discussing inside information. So, to answer that one. Posting something on a BB is NOT manipulating a share price (whether your post is true or not). The only info you should trade on is info supplied by the company. Besides, there's no law against revealing any info about a company as long as you're not contractually prevented from doing so. What you're not allowed to do is act on any info you have (by trading shares) if the info isn't made public. As far as I can see, as long as Rich9 hasn't traded on info he's been given, he's not got a problem and can say whatever he likes. However, the company and its board have a duty to clarify the situation if there's a lot of speculation or if an event occurs which is material. Let's see if they do. Also, why are you defending a board and it's CEO for their extremely poor performance. They have run this company into the ground, in no way could you seriously claim SB has "kept things going"!! He's failed. He's in charge and is therefore responsible. He's lost all the contracts and the money he inherited and raised has nearly all gone. How is that a success!! Why don't you tell us what your real agenda is here because your attempts to defend the indefensible are BIZARRE!!!! | 2float | |
14/3/2012 08:42 | richmond i can`t be botherd to look back to 2007, but he must be looking at a big loss now anyway. interested in your thoughts, are you saying if SB hadn`t stepped into the breach WNG would still be trading, and in profit... my thoughts are they would have been bust long time back. at least SB kept things going, allowing the smart investor to exit. i have been on the wrong end of a few crooked AIM companys which have just gone bust without warning, and have lost plenty of money. but you have to balance the portfolio. i am still up 450% since the crash, was 650% this time last year, but i can`t blame SB for any of that. 14/3/2012 08:30 | and just to confirm before you ask:- I have managed to get a copy of the minutes from the first meeting (27/8/2007) and the subsequent correspondence between the board and SB during September 2007, as well as a copy of the share register from capita registrars showing when SB purchased his first shares. Amazing what people will tell you and hand over when the SFO investigation is over. It appears to me that SB has behaved appaulingly over the past 5 years and upset a lot of people both within MSS and in its wider, advisor, customer and supplier base. | richmond9 | |

I have a detailed file on the source of information and the necessary backup for the authorities. I have been doing a bit more research. SB was introduced to the board at WNG(MSS)in August 2007 and was given inside information by Cenkos about the company's position following the profits warning earlier that month. He subsequently purchased shares in the company (in Sept 2007) and forced an EGM as an outraged share holder. Question: Is it insider trading to purchase shares when you have been made an insider? | richmond9 | |
14/3/2012 07:48 | 2 float you are missing the point banter between two bb posters is one thing, but continually hammering a company with so called inside information, that may or maynot be true, and has not been RNS. could be called manipulation of the share price for the record i do not have a position sold my last batch when the RNS was issued that we had sold to rentokil. the share price spiked which i wasn`t expecting so took the oppertunity. will buy back in if we see 0.25 WJ. | w1ndjammer | |
13/3/2012 23:31 | Windy Slander cases (BB's come under slander) aren't pursued because they're not worth it. Biggest ever web based payout is about £100k. Most cases don't get north of £20k. Libel cases (press articles come under libel) run into the millions however. Now, who was it that put stuff in the press about the way the company was previously run? You seem to consistantly go out of your way to defend someone who's utterly failed the shareholders. Why is that? As a shareholder, surely you're not happy with the performance of the company since SB took control, have you looked at the share price graph for the last 4 1/2 years??? | 2float | |

13/3/2012 15:54 | Nighthawk Energy plc ("Nighthawk" or "the Company") Bulletin Board Legal Action The board of directors of Nighthawk, the US focused hydrocarbon production and development company, is pleased to advise of action that has been taken and is continuing in response to persistent defamatory and untrue postings on the Interactive Investor Trading Limited ("iii") and ADVFN plc ("ADVFN") bulletin boards. The postings concern the operations of Nighthawk and its management which the board considers to be extremely damaging to the Company and its reputation. The Company took steps to identify the posters who try to escape liability for their defamatory postings by hiding behind a cloak of anonymity, using anonymous email, social networking or bulletin board accounts to disseminate those postings. In some cases the names and other details used to register these accounts are fictitious and posters also can try and cover their tracks using numerous pseudonyms but they can be traced through their IP addresses. The operators of the bulletin board services can be prevented by confidentiality and data protection laws from disclosing the names and other personal information associated with the accounts. However, the English Courts can exercise their discretion and order such disclosure, provided certain criteria are met. In the High Court of Justice on 28 June 2010 Nighthawk obtained a Norwich Pharmacal order instructing iii and ADVFN to provide information in respect of various posters, who were posting material that the Court accepted could be defamatory. Both iii and ADVFN are assisting the Company with providing the relevant information including details of the posters. The identities of various individuals behind these postings have now been established and the Company and its directors are now considering with their legal advisers instituting civil proceedings against them for defamation. Further announcements will be made as appropriate.
