Penalty

Penalty for this offence is imprisonment for not more than 6 months on summary conviction or a fine. As in Accordance with Penalties for Disorderly Behaviour (Amount of Penalty) Order as amended by Penalties for Disorderly Behaviour (Amount of Penalty) Amendment) Order this offence is a fixed penalty offence and the penalty is £80 for persons aged 16 or over and £40 for under 16 years old persons.



Of course I know the name of the Inspector that said that further complaints may be dealt with in this way * but I wonder what it could be? *

cutthecagain really is desperate.

There is NO VALID DEFENCE against Criminal Harassment, Malicious Comminications and so on.

I have posted on here several times: read the Crown Prosecution Service guidelines to the Police, they're on the Internet and one no longer has to go to the books, as one did in the old days.

But if people won't do that, and think they can rely upon amateur interpretation of the Eady J. case, that's up to them I suppose.

What makes matters even worse is when the offences are repeated, forming what's called a "Course of Action". One single offence - an isolated rant, for example - doesn't constitute such a Course. But when it is repeated, it does.

Oilman63 has removed the content of his posts on a colossal scale. Large numbers of them were saved including those in which he encouraged people to try to get one of the other GKP shareholders sacked from his job, by posting his victim's employer's details and contact numbers etc. The Police have those latter posts. In any case they are all retained by ADVFN, as a simple search on the original text immediately reveals: the post comes up, but without the text. It's all still there but not visible to the user.

Considering "Oil_Investor" has already been given "fair warning" by the police that further complaints may be dealt with as wasting police time (a conclusion drawn from what was considered "GOADING") it is my opinion he is on a very tight rope.
