What do people with experience/knowledge of these things think is a realistic minimum amount that EML could win, assuming a pre-tribunal settlement by the Moroccan government who will want the matter resolved quietly to avoid embarrassment and lost time for OCP?The larger of (a) the Singaporeans' average share price and double it, and (b) total amount invested by EML and double it, would be my very finger-in-the air guess.I'm watching here, took a massive hit 3 months ago but I do see the possibility of a good outcome for the patient.

What we want is focus, that someone or group of Moroccan officials focus on the problem and alter whoever or whatever law(s) to allow EML, continue work in Morocco.

interesting analysis of the EML situation, don’t know the guy but from his bio he specialises in investing - if that’s the right word - in these litigation plays. And he’s up front on his winners and losers.

Could takes years at worst, probably many months at best - and that’s if Morocco try to make it go away quickly.

Even with very hefty discounts to NPV and assuming all the costs - as he’s laid out - it’s still interesting, maybe enticing even for the patient…

Emmerson PLC – (EML LN) – Litigation and working capital funding secured for up to US$11m

Emmerson PLC is looking to progress its legal dispute with the Government of Morocco over Boies Schiller Flexner LLP has been confirmed as Emerson’s litigation counsel.

Emmerson completed a scoping study on its 100% owned Khemisset Potash Project in Morocco in February 2024.

The study proposes the use of a new and proprietary processing process to treatment potash brine to remove magnesium and iron chlorides through the addition of phosphate and ammonia.

This allows the residual brine to be recycled offering significant environmental benefits through the elimination of deep well injection and halving of water consumption.

The new process claims to increase the recovery rate of MOP to 91% from 85% along with the production of two new slow-release fertiliser products, struvite and vivianite.

Scoping Study economics:

Post-tax NPV8 US$2.2bn from NPV8 US$1.0bn previously
Post-tax IRR of 40% from 26%
EBITDA US$440mpa vs US$258mpa previousl
CAPEX US$525m vs US$539m previousl
AISC: US$163/t

Conclusion: The securing of litigation funding lends some credibility to the claims by Emmerson over its Khemisset project in Morocco.

While the Kingdom of Morocco trades extensively with the US and EU other miners and explorers will be watching this case with close interest.

A completely different industry, but Novacyt took the DHSC to court for breach of contract, in a seemingly open and shut case. Novacyt ended up settling out of court by paying DHSC £5mn. If EML is so confident, why won’t its shareholders fund the whole case themselves? Presumably because they recognise it’s a gamble and EML’s record is not exactly trustworthy. The project was meant to be in production years ago.

Frankly it doesn't matter, nor do most people in EML give a toss about the degree of Morocco's development, now that we know an EML mine will never be built.What matters now is the open and shut case that shows Morocco is guilty of massive breach of an international treaty which they are signatories to.It matters a lot that this treaty is very well established, has over 100 country members and has had many claimants sue the balls off their counterparty.Is 500m claim out of the question ? No.Morocco made a massive error is dishing out favours to OCP while it persecuted EML, quite obviously.It's going to cost the king quite a few a ton of cash and quite a few of his servants their jobs.So please, don't bother with me with more of your pish.

I believe my first post ever on EML was last week but more than happy to be proven wrong. That the OCP acreage is next to EML is irrelevant. As far as I'm aware EML acreage has not been handed to OCP. At the moment EML are stuck at the ESIA stage.

This hurdle needs to be cleared first. If the Moroccan government are requiring ESIA standards from EML and not from home grown competitors then they may have a case.

cyberbub - Reference to treaties are the last resort only when governments disadvantage companies and individuals by law.

For example UK company A purchases 100 acres of land for gold exploration from country B. Surveys reveal the land area contains one million tons of gold. Country B then changes the law and states no foreign company can own more than 10 acres of land.

UK company A has effectively had 90% of its land expropriated by a change in the law. UK company A cannot appeal to the courts because that is now the law of land.

It is at this stage UK company A can seek international arbitration against country B.

From what I understand one government department has stated EML ESIA does not meet the required standard, that's all. I'm not aware of any changes in Moroccan law that has brought these circumstances about.

EML next port of call should be the Moroccan courts not resort to international treaties.
