I note that Railtrack are taking HMG to court on the 27th of June....and the case has been allowed to go forward as a direct result of information recieved under the `freedom of information act`....ref todays `Telegraph`....the case is based on the timing of the decision to pull the plug and the application to the courts for the administration order....Railtrack investors have applied for all the information that was relevent between these two events....and it`s on this information that they base their case.....basically HMG themselves had already decide on the administration route at the expence of all other options and parties prior to the application of the order....and only went through the motions of seeking an alternative arrangement for the benefit of shareholders.....this latter point is to be proved in court and on which their case rests....implying that the decison to `pull the plug` was made before the charade of any meetings or disscussions between all parties concerned....and the meetings were used to `rubber stamp` a foregone, prior decision...in which the shareholder had no influence on the outcome.

I wonder what the ESAG make of all this...and although a sell off is undoubtedly perfectly legal, nevertheless highly immoral in that a few directors of a `shell` company are to walk away with mi££ions of pounds profit..at the expence of the multitude of original shareholders. Presumably. if the potential purchaser ignores the plight of existing Energis shareholders....the ESAG battle continies? .....however the options open up with the sale of the company in that the new `owner` could give existing Energis shareholders favourable terms in the form of warrants/future exercisable share options/non voting`b` shares etc,etc, in the new company as settlement of claims against the company?.....however this form of negotiation must be undertaken by the ESAG.p.s I wonder if any sale would include `Energis Polska`?

no - just moved on - and the energis loss was very usefully used to offset much bigger investment rather than trading gains elsewhere

Good morning all
Just an observation, If day trading is profitable why are so many of the names trading one or two years ago no longer around,Have they lost all their money or just learned to trade more efectivly.
