I also lost a reasonable amount on EGS - and liase with them (energis) on a daily basis (international carrier services) - they really do provide a great service - just treat shareholders badly - anyway if its "promote a share month" try RTD - afterall I have recovered my energis losses 2 fold from these

- or even ASD - steady riser
I dont feel guilty about ramping on here cos the chances are no one will read it !!!

I see that British Energy are to return to the stock market next monday.Once valued at £35m and at £88m prior to delisting,however are now to be valued at around £1bn plus...it`s amazing what creative accountants can do with numbers considering it had a debt of £6bn.(ps.. my advise is to buy Ramco...maybe the Telegraph got it right after all...just a bit late

Good Evening Folks,
I think it is about time we drew a line under Energis, I personally lost about £27K in Energis, No doubt others lost more. We have tried the legal way to get redress which proved to be fruitless. Put it down to experience and move on.
My advice is to buy Prudencial Insurance, over the short term.

REMEMBER YOU CAN NEVER WIN OVER THE PEOPLE WHO HAVE TH MONEY.

Some of the stuff one reads on these boards is hard to comprehend...MyTravel,for instance,fought tooth and nail and even applied to the courts to retain it`s shareholder base and this is a company with 14 billion shares and 39billion warrants in circulation...?....why?

p.s ......The `Sunday Telegraph`...won`t be able to tip Energis as `share of the `year`..........this year.....`yes` I`m a `Telegraph` reader...and `yes` I got caught.....as I said in the previous post....don`t believe all you read. I read and accepted all the disclaimers...but no mention was made of the possibility of the proprietion of shares by a third party?. Questor, (Telegraph tipster) nearly did the same again last year...with Ramco, a share of the year, which began the year at £3.65....and is currently trading around 24p with rumours of ....well you just don`t want to know....well done Telegraph, you can sure pick`em.

Don`t believe the hype........British Energy are seeking court aproval to extend their reconstruction plan and are still threatening insolvancy to it`s shareholders unless they agree to back the new plan...the books are not balanceing and they`re still heavily in debt, but are the bondholders, who are to inherit 95% of the company worried...no.With bonds trading at 235% of face value, they`re getting the company for nothing......and from yesterdays `The Independant on Sunday`.........`lawyers acting for disgruntled Railtrack shareholders are preparing to use the `Freedom of Information Act` to access files which they hope will prove that the company was put into administration unlawfully.Memos and minutes of the meetings will be used as evidence in a court case against the former transport secretary,Steven Byers, which is due to start June 27th.Represented by the law firm Edwin Coe and Michael Crystal QC, the group of 55000 private shareholders are planning to lodge requests in the next few weeks for documents held by the Office Of National Statistics (ONS). Under the new Act, which came into force yesterday, the Government must disclose the information within 20 days of request. If it refuses , the case will be passed on to an idependant arbitrator. It would be a criminal offence to destroy documents.. Railtrack shareholders are seeking information that led upto the decision to go into administration. David Greene, head of litigation at Edwin Coe,acting for Railtrack said,"We are planning to use the Freedom Of Information Act with certain government institutions.For example we will use it to gain information held by the ONS.We are very interested in the ONS`s determination in the lead upto administration"....the Act covers all emails.....added to this we have the seven year documentation rule...we now have an armoury....we still have (hopefully) and ESAG battle corp, all we need to know now is ....when does the battle begin?....2009 will be too late.

As i see it Chelys was set up and bought the UK business of Energis off the administrators,so chelys have nothing to do with Energis PLC and have nothing to do with the administration.This is how they have got round it and left us with nothing.

As the family 'investement manager' (ho ho) I am only begining my 'proper' reseach into this Energis business -- dispite my serectary advising me that I have much better and more profitable things to do --- like running a business !!

However this is much more fun! And, may, ulitmately prove financially rewarding !

I suggest 'We' all take a look at 'The Chancery Guide 2002' Chapter 20 The Companies Court -- section 20.10 Petitions for administration orders.

It says "An administration order is an order directing that, during the period for which the order is in force, the affairs, business and property of the company are to be managed by a person ("the administrator") appointed for the purpose by the court."

As I understand the current position Energis is still in 'administration'. So who is doing what ? And what exactly are Chelys doing and for whom and with what authority ?

Anyone like to set this out - please.

I am consulting with my legal advisors.

'We' should also be aware that in certain circumstances an administration order can be extended simply by an application made in writng at the appropriate time. 'We' may not have the opportunity to have our say. You (We) have been warned!!!

I trust that chap 'Jack-attack' did find 'good old David' hiding in his wardrobe!! And, what a nice supprise that would be to.!!!!

Thanks for the reply Adrian.....just a political ploy then, a delaying tactic....so as not to become an election issue.The question is, will the outcome of the bill be seen in a more favourable light should the Tories come to power?....While I`m on the boards,when are the ESAG going to make a stand against Cheyls,objecting to the scheme of arrangements...even`the 1985 Companies Act` under which the shceme of arrangements was issued, allows, under article 427, paragraph 3 section (e) `that the scheme of arrangement makes provision for dissent`....I`m sure we have enough `ammo` now.?....Personally I`m curious how they are going to get around part 151 (1) which states that financial assistance under `the scheme` is forbidden......how will they explain the £150m imput....I noticed that they envoked clause 371 (1) to get around the majority rule situation...`whereby ````one memeber of the company in person or by proxy be deemed to constitute a meeting`....therefore the reciprical must also apply....that a single shareholder may be classified as a legal `dissident`....and put his/her case towards the courts......if we don`t get any response or advice from th ESAG....we`ll have to go it alone.....wish us luck.

The Lord Chancellor has not sided with the Countryside Alliance. The Attorney-General has stated that he will not oppose an application for an injunction pending determination of judicial review proceedings as to the constitutionality of the Hunting Act. The case centres on the legality of the Parliament Act 1949, which was used to pass the Hunting Act against the will of the House of Lords.

The C & A's argument on constitutionality is complex, but few commentators believe it will succeed. The Hunting Act will, I fear, be upheld, but it will take at least a year for the litigation to run its full course.

There is a separate argument based on the Human Rights Act 1998. but, again, don't hold your breath. It was tried, and failed, in Scotland.

My Travel shareholders are offered a 50 to 1 dilution....(better than nothing). Hutchinson Whompa to float for £3.5bn,China Airways also to float at about £3bn, both on the LSE. This is making the FT100 a crowded part of the world...and tougher for Energis to get back into when they decide to re-float.P.S I noticed the Lord Chancelor has `sided` with the Country Side Alliance and granted an injunction against the governments `done and dusted` deal banning fox hunting on the grounds that`all legal avenues opposing the ban have not been exhausted`....undoubtedly politically motivated, never the less...sets a precedence.

Energis says no to "uneconomic" LLU
Energis will not invest in a national local loop unbundling (LLU) program, it was announced today.

Energis has seen considerable success with its strategy of delivering great service to large corporate and government customers. This decision frees up investments enabling it to accelerate that progress. Customer service and innovation will drive the next round of Energis' investments.

John Pluthero, chief executive of Energis, comments: "LLU is uneconomic for national roll-out. It involves a significant up-front investment with no apparent return in any realistic timeframe. Frankly, we've got better things to do with our cash.

"We're putting all our time and effort into executing our strategy. Yes LLU success could be good for consumers, but there are other exciting technologies that we will invest in which will offer our customers even more services".

I used to be a `full` glass` once,..cut my teeth on NFC and did very well, then encountered, Maxwell,BGY,EGS,, however, the AHT`s,PIC`s and IRV`s had balanced the books, even made 100% out of Ionica that went to Volantary Admin.I took the maxwell and BGY losses in my stride.....I just feel a bit `cheated` over the loss of EGS...because as part owner of the company, had no say, or vote, in its future.(even BGY gave us a vote on the outcome of the restructuring plan...albeit with a gun to our heads)...if it`s any help I`ve been classified by phd insurance assessors as `a pro-active stoic`.......(..sounds like an `empty` glass to me).

just a couple of quick ones this week...I noticed the Energis results,from a loss of £390m reduced to £43.6m...Take a quick look at ASHTEAD Plant, losses down from £600m to £500m....and the company has become the stock exchange `darling`of 2004 (but then what else would you expect when the board comprises of ex-accountancy partners of a national accountancy firm) (p.s Rentokil, as a major shareholder, paid £1.50 a share for Ashtead...and they Will return to those levels)...the other point being, on monday last, protesters of the expansion of Stanstead Airport, were granted leave to appeal in the High Court against BAA on the grounds that they had not been sufficiently informed ( as an Energis shareholder that rings a bell). By Wednesday the court hearing had been abandoned in view of the fact that some form of compramise had been reached.
