18/4/2016 15:50 | Completely hypothetical , but what if at the eleventh hour, one of the perpetrators of the accusation that CHL had committed fraud came clean to his government that the whole thing was fabricated. This would mean that the fraud review would be lost. The ROI govt would see the futility in carrying the arbitration forward with so little credibility remaining and so back away to cause further delay to the process. 18/4/2016 15:48 | I was reading other BIT disputes with ROI the other night involving Freeport and Newmont mining. Roi after deals were in place and mining underway hit both companies with new laws to pressure them into building smelters and finishing industries in indonesia to increase the value of products and skill up their workforce. I think Freeport did a deal and ended up paying higher port duties and royalties whilst newmont shut it all down leaving 3200 with no income until a deal same as freepirt was completed. Two wrongs there in my book but the end game for Roi is that they ultimately want more control over their resources and cant blame them for that and BITs are actually way more in favor of the companies in terms of power...it appears as the dutch agreement has ROI by the curlies for 15 years after BIT elapses. Suggest read about them and despite Chl definitely suffering rough play at its worst I can see the view from ROI angle too. They need to negotiate future BIT's more carefully and protect their interests but after losing so many in the past I think they are setting up for another..odds are stacked but obviously the law and ICSID will prevail. 18/4/2016 15:44 | I've been in CHL too long to get too over optimistic, but it is worth remembering that many other countries like ROI do have a different approach to matters like this, and their governments will step in and look to take credit for things. Witness the fact that anytime Chinese leaders go anywhere, or anybody visits China there has to be a photo op with the grinning leaders signing some trade deal supposedly worth a fortune to each side. I'm not relying on it - the merits of the CHL case are a far more comforting platform to invest from. But it wouldn't be a shock if the end came quickly.
