Thanks guys. No wonder Astor brought the matter to court as it will define whether they will get their money at all.

I like the scenario you have painted LLB and if the case goes our way we would be in a very strong position to negotiate an overall agreement provided Astor don't want to write off their loan, which I must say would make no commercial sense.

Fingers crossed then and maybe IF we do win (I don't want to tempt fate)then some here might revise their opinion of Traf.

My understanding Husbod is that 'senior debt' is bank debt.., inter company/shareholder loans, which we have used, and equity based fund raising do not qualify as 'senior debt', this is the nuts and bolts of our case to be ruled on shortly..

IMO the ruling will be that the debt exists, but has not been triggered due on the basis that 'senior debt' wasn't used, this will then be used by our team as leverage to renegotiate the full package (1) payment terms, (2) the brokerage fees, and (3) the additional deferred payment if Copper goes over $3.00 for 12 months, and a new deal will be thrashed out to our advantage..

Excuse the ignorance but if we win on the point that payment is triggered only on our taking senior debt then does that mean that effectively we wont have to ever make payment provided we raise any funds, if we have to raise funds, by way of a rights issue or placement. Would it also mean that any loan by Traf or the other Two big holders (ie excluding Liberty)would be considered to be senior debt?

Market settled at around 150p, probably halfway between favourable/unfavourable settlements. Interesting investment for those that specialise in legal cases but a pure gamble for every one else.

Keep having nibbles at the share as the case does seem to be holding back the share price Given what we know, am fairly confident Astor case will fail. Hopefully if timed around an update we might finally test a new range (higher).

Copper firming up as BHP workers look to strike tomorrow..!



Workers are also demanding to sign a 36-month contract that would include a 7% wage increase and a 25 million-peso end-of-conflict bonus.
BHP is proposing a 48-month contract with an 8 million-peso end-of-conflict bonus and no wage increase.

Copper has surged more than 20 percent since mid-October as stockpiles tracked by the London Metal Exchange shrank. Goldman Sachs Group Inc. says prices could exceed its six-month target of $6,200 ($2.81/lb) a metric ton because of potential supply disruptions..

I don' see how Judge Legard can rule any other way given his opinion of the value of 'good will', and when our legal contracts are as they are..

Liked your cross-reference to KAZ too... and GLEN has almost quadrupled...

I'm sure we're just waiting to get the Astor business behind us, whatever the outcome and then once we start declaring profits, the sky's the limit...unless copper collapses...or somebody takes us out at 300p...?

Who knows...?

Copper touched $2.65, gold $1235 and silver $17.76 overnight...all at or near resistance levels...

AIMHO as usual...
