Over the past 2 years, I have subscribed to level 2 on ADVFN, using my credit card. The credit card expired in March 2021. ADVFN posted a message on my ADVFN profile, reminding me that I need to update the card details. However, I decided that I didn’t want to renew the subscription, so I ignored the reminders, waiting for ADVFN to cancel I my access to level 2.
In late October/ early November, access to level 2 was denied, so I presumed that was that.
Then, on the 18th November 2021, £638.88 was taken from my credit card. I have queried the transaction with Barclays (credit card provider} and I have queried the transaction with ADVFN.

Please note that the 14 days cooling-off period mentioned in the Terms & Conditions is not referring to the subscription's renewal but to when the subscription was originally added to your account.

Due to the reason mentioned above, it won't be possible to refund the latest payment processed on your credit/ debit card.

As things stand and according to you're prior correspondence, we have entered a new annual contract which will expire on the 18th November 2022. I have therefor the statutory cooling off period of 14 days in which I can cancel the contract. I am trying to exercise that right or are you saying I do not have that right?

Dear Sir,

Thank you very much for your prompt response.

Please note that the Level 2 subscription was cancelled due to the fact that we weren't able to process the payment and not because you requested to remove it from your account.

When declined transactions remain pending the system automatically re-charges them on the new card as soon as a new number/ details are available.

Please note that sometimes when a card expires is not necessary to update the details manually as the bank account remains untouched and the source of the money keeps being the same as the previous card.

When you set up the subscription on the 5th of November 2018, an email letting you know the renewal dates and terms of renewal were sent to this email address - [[e-mail]]. The email states:

"You may only terminate your subscription by giving ADVFN not less than 30 days written notice or a phone call. Termination does not entitle you to any refund. If you do not wish to use your subscription and want a refund, you must terminate (a) before using the services; (b) within 14 working days after the date of initial purchase. No refund will be available once you have started to use the services. By purchasing this product you have agreed to abide by our terms and conditions (see

Your subscription does not renew using Direct Debit, which is why you have not had to authorise that. The service renews using continuous payment authority, which you granted us when setting up the subscription.

In order to cancel without being charged again, we would have needed to have received your letter or a call to cancel at least 30 before the renewal on the 5th of November 2021.

As the notice was received after the 2021 renewal date, the cancellation has been put through in the manner you have agreed to, specified in the terms and conditions and will stop on the 18th of November 2022.

The amount should not have been taken from my card which was renewed earlier this year.
Details of my new card was never given to ADVFN so I will be contacting my bank to see why the payment was made when ADVFN had never been given the necessary information. I shall also be enquiring why a refund cannot be made given the payment is only recent. ADVFN had already cancelled level2 on my account, so I thought that that was the end of the matter.

I am afraid to confirm that since the annual payment was already taken from your card on the 18th of November 2021 (renewal date) we won't be able to cancel/ refund this year's payment.

Due to the singularity of the situation, I personally processed the cancellation of your subscription which will take place on next year's renewal date (18th of November 2022).

If you will change your mind we will be able to offer you a 25% discount on an annual basis from next year.

Now there are 2 issues:
How did ADVFN get my cards updated details and why are ADVFN refusing to re-imburse my money given that I have requested cancellation within the 14 day cooling off period. I was wondering if anyone else on these boards have experienced issues like this and how they obtained redress.

Except it doesn't say that - the full sentence says:

"This will ensure that Shareholders' votes will be counted if, ultimately, Shareholders (or any other person they might otherwise appoint as proxy) are not permitted to attend the EGM in person. "

Let's not have another Prat situation where things get misquoted, misrepresented or just made up...

It's clear enough that they don't want awkward questions, or indeed shareholders turning up; it's also clear enough that they can't (at the moment) stop shareholders from attending.

I wonder if the uncovered misappropriation of funds was the result of the company being audited in preparation for a buy out by a Canada HQ'ed miner. SBI has bobbling along with "unique" management for years - late deliverables, UK office armchair mgmt, ... Activities and events that have filled pages on this blog.

Boris - that just means that they have a good position in terms of resources which we (or more precisely my predecessors as shareholders) paid for, tapped shareholders for cash and they still have it. That doesn't justify mismanagement, and that mismanagement being meekly accepted, on the scale that has occurred.

I agree - it's a farce that 6 years of cash going missing, not to mention the other failures in financial control, can be ignored the way it has been; and the 'Chief Financial Officer' has no responsibility etc. And he came out with this gem in the annual report in the second link above:

"When we look back at 2020, I think all things considered it was a very satisfying year."

It's unacceptable.

Mmmm.

There is to be an EGM - on 22nd December at 2pm at the offices of their lawyers. Not the optimum time for scrutiny of their various activities since the previous AGM. And it seems that as they can no longer scream 'Covid' to get people to stay away, so they are reduced to 'discouraging' them from doing so - but they can't actually ban them. So a pretty desperate effort to avoid accountability, imho.

They will, of course, restrict any questions to the precise business of the meeting, and exclude any questions not related to it. Nevertheless, I'm minded to pitch up and see what's what, and ask some questions - combined with a Xmas shopping trip etc etc.

One to ponder...
