What if someone smelling something wrong pulled out just before the suspension (taking losses of course)? Would that be the ground for an action, or is it just daydreaming? There was actually a very big debate on the Langbar thread in 2007 about whether losses could be recovered with a trading history. Not quite the same scenario but the final conclusion was that previous trading history was not relevant. Of course this could be different if claiming from the auditor - but certainly worth checking legally before posting. And as bigboots was in Langbar - perhaps he might be best placed to know. Jaknife will remember the debate too. It would seem from your court summons that you subsequently went materially long. From this, it would seem that you were trading this share, rather than investing in it; the mistakes you made being (1) to close your short and (2) to reverse to a long.
