The way I see it they are not paying for getting it wrong (badly) in making a "land-grab" for Churchill's assets...............they are merely paying for the assets that they "stole" and at 2.3Bn tonnes of coal (at least) they will be getting significant value in return - EVEN IF they were to pay the full present day value of the claim PLUS interest.

If they did the same in all similar instances I believe they would be getting a GREAT DEAL - valuable assets at a knockdown price?

Time will tell.

Now they got money for other things maybe the purse strings not so tight :-)

Apparently though they have a seperate fund waiting to pay for disputes.
One of the problems is if they pay us it will set a precedent and I dont know how many other miners would qualify for a case against them

II. POST-HEARING BRIEFS
3. The Parties shall simultaneously submit a first post-hearing brief commenting on the
evidence gathered at the hearing and responding to the questions of the Tribunal set
forth below in paragraph 6. Pursuant to the Parties’ agreement of 17 August 2015 (the
“Parties’; agreement”), such brief shall be filed on 12 October 2015. It should not
exceed 50 pages (with answers to Tribunal questions). The first post-hearing brief
shall append no new documents, except for legal authorities in connection with
question (h.) in paragraph 6 below or except with prior leave of the Tribunal.
4. Pursuant to the Parties’ agreement, the second post-hearing brief shall be filed on
9 November 2015. It shall append no new documents, except for legal authorities
strictly in rebuttal of those filed with the other Party’s first post-hearing brief or except
with prior leave of the Tribunal.
5. Having considered the positions set forth by the Parties at the end of the hearing, the
Tribunal confirms that the Parties are to address matters falling within the scope of
Procedural Order No. 15 especially paragraph 34. In other words, the Parties shall
address (i) the factual question whether the impugned documents are authentic or not
and (ii) the legal consequences of a finding of forgery. Matter (i) includes the question
whether, if they were not handwritten, the impugned signatures were affixed with
authority. Matter (ii) about the legal position in the event of forgery does not cover the
effect of the possible invalidity of the survey and exploration licenses on the

exploitation licenses. The present directions come in lieu of any different comments
made by the Tribunal at the hearing.

Rosannon Why not? They have in every other instance. The last decision regarding jurisdiction has been written about by many commentators. We may not get the full text straight away, but we will get the reasons for the decision in my opinion.

Do you think Iscid will publish details ?

Even if this takes till Dec Jan you never know if we win this round Roi could throw in the towel and payout.
So I expect traders to be positioned before Dec but meanwhile,money could flow back in if we hit the next support or as news comes from Iscid or from those in the background that know.
I could also sell and play somewhere else in the hope to buy back at 22 like probably a few are planning but if I miss the bottom or lose somewhere else ?

I prefer to have just as near to a safe bet as I can and be patient.

Jakarta. Indonesia's coal output declined 15.4 percent in the January to August period this year on the back of low demand, a ministry official said on Monday.

Adhi Wibowo, director of coal business development at the ministry, said that Indonesia's coal production was 263 million tons in the first eight months of this year, down 15.4 percent from 311 million tons in the same period last year.

"The production decline is caused by the low global demand of coal," Adhi told reporters on Monday.

He also said that Indonesia's coal export declined 18 percent to 211 million tons in the January to August period compared to 258 million tons in the same period a year earlier.

Coal miners continue to face challenges in the industry because of weak commodity prices sparked by lower global demand.

However, Adhi added that the weak coal price did not affect the domestic demand for coal. The domestic volume reached 52 million tons until August, down one million ton compared to the January to August period last year.

"The domestic demand remains stable because there are needs for power plants and the industrial sector," he said.

The coal output reached 81.88 percent of the total target that the government set for this year, which is 425 million tons.
