24/8/2015 17:42 | I've been away for a week but have now had the chance to read P.O. 20. As I see it the noose is tightening on ROI. The whole flow of the ICSID P.O. and requests is to crystallise the main issues in dispute and demand answers from both parties. CHL can give those answers. ROI can't. Even if ROI can convince the tribunal that the persons issuing the licences did not have the proper authority (and that is doubtful) the question is now being asked of them bluntly what the legal consequences would be. (ie the point about CHL being entitled to invest in ROI in good faith). The one downside I see is that ROI have not shown any good faith at all, clinging desperately to a dubious position to avoid the day of reckoning. It does regrettably suggest they do not have the balls to do the decent thing and settle up anytime soon. So the waiting game continues, possibly for a number of months. But they are running out of avenues now. It might be taking longer than we would like, but CHL's case looks better than ever, and it isn't going to go away. GLA FC | flyingc | |
