Is that CPX versus Maxwell, I would not be surprised if they find a way to delay, or Tesla's countersuit designed to stomp this minnow in to the dust?

It remains for CPX to deliver on its promises and come up with sales and revenue performance. If there was an obviously viable business it would be worth Tesla's while to execute a takeout. Here in vain hope things will turn up.
