So it seems to me that their statement on 9th June 2021 that: "In the opinion of the Board, properly advised by legal counsel, the net claim is unlikely to be material." could be construed as somewhat inaccurate and misleading as in fact it seems to have been quite likely to have been material. The wording of the response to his question re the deadline for a decision is ambiguous. It refers to “the deadline for the application”, not the deadline for the LCC’s decision on the application.
