21/9/2016 08:00 | The cases are going through summary judgement requests by the various Defendants. Factset has been dismissed and terminated already with a report submitted by the Court to the Commission of Patents and Trademarks for Patent/Trademark Number(s). The others are going through summary judgement requests I believe. We have just submitted an answering brief letter to Judge Sleet in response just yesterday. We will know the outcome in a couple of weeks.Not sure if David Ellis Moore is acting for Interactive Data Corporation only or the rest of them but he is the one submitting the summary judgement requests as Factset did. 09/9/2016 20:41 | It would be Quest who win plus also what a "win" entails. Starting from best scenario... 1. The "win" could be a big award payout that filters through the various onward asset transfers of the patent from Worldlink ITS, to Worldlink Technology Management, to The Betting Service etc, back to the PLC. The PLC is still in liquidation but crucially is not dissolved yet and the Liquidators are keeping it open until after the trial result is known. The £180K deferred consideration has been paid into the Liquidation account so an apparently legit route back to the PLC exists. Our share of any payout (after costs etc) would need to pay of the £4.5M creditors before it then comes back to shareholders. It would need an unprecedented payout but that is what we are here for isn't it?! 2. The Markman hearing gave the Defendants virtually everything they asked for (read it for yourself rather than take anyone else's opinion, it is from the Judge himself so is incontrovertible). It is very possible this severely limits the scope for a large payout even if we get a technical "win". Even so, a nominal payout would still be a big result for Quest as they will get their 7 figure costs back and not have exposure to the Defendant's costs. Set against the total loss of the monies invested so far and the prospect of the Defendant's aggregated costs, this would still be a big win for Quest but unlikely for PLC, creditors or us. In future though, everyone else will know we actually WON the case so settlements from others would be much more likely as paying us something now is better than a near certain defeat in a trial with the costs that entails. 3. It is possible that the parties will do an "undisclosed" settlement which is along the lines of zero payout but the parties call it quits and agree to pay their own respective costs. This would give us the ability to say it was "settled" and avoid a far larger exposure to their costs. I call this a "win" because our patent would not have been declared invalid or been defeated via non-infringement. We would live to fight another day. However, in truth Quest would not be able to afford the costs if it loses and the loss of its own costs would be a hammer blow so they might as well go to Court now and roll the dice. 4. Or we lose. The only scenario I cannot see happening is the Defendant's doing a real settlement. i.e. accepting the patent and paying licence fees and compensation. So fingers crossed. I hope for 1 but seriously doubt it and 3 is very unlikely. I think we are somewhere between 2 and 4. If we get past the patent invalidity attack, my money is on 2. 2 is still a very good result but it might just take a bit longer for money to reach PLC and ultimately shareholders. | hugosamuel | |

He has been painted as a villain well I just tend to give people the chance to prove themselves and I think We shall all see that we have not been lied to and scammed as so many assumed? There is so much more to this story than meets the eye?
