CHL and ROI were asked by the Tribunal to consider this issue. CHL emphasise that there was no forgery by themselves or their partners, Ridlatama. Nonetheless they addressed the point as requested and made a series of detailed arguments why the case would continue with a valid claim. You would need to read the detail in the protocols as, unlike rossannan, I don't believe anyone without a legal background can assess the merits or otherwise on the complex points CHL's lawyers make on estoppel etc.

Read the past RNs's, whether chl win or lose the tribunal does not end here.

The case continues to merit phase. If we win then expect nice payment from roi at the end, if we don't then it may be considerably less, but certainly more than current MKT cap, we will challenge with estoppel ..

Sorry - I was short-cutting a step - if the licences were forged then my understand is that our claim is dead though I may be wrong - it was years ago I first invested here and I haven't refreshed my memory recently.

Wilfy - if ROI lose on this authenticity of documents decision then, in all probability they really have played and lost with their last card. In effect it means ROI can either capitulate and try and settle OOC or continue through the arbitration with the aim of minimising quantum. If they do that, however, CHL have intimated they will up their claim to over $2 billion. CHL can only do that if ROI dispute the current $1.3b plus interest. CHL have explained that the original valuation only took into account 30 years of mining, however, a valuable resource would remain after 30 years.

For balance I should add that they might try and dredge up issues relating to alleged forestry breaches, however, it's on the record as the locals being supportive of CHL. ROI look to have a weak case on this issue.

So, as you can see, this document phase is pivotal and if CHL win the stock looks highly de-risked. If CHL get the decision and ROI continue the battle then CHL will look to raise $3 to $5m to take them to the end of the process. That would mean an issue of about 5 or 6 million shares as almost certainly CHL would be trading above 50p and might spike much higher than that. September is set to be an interesting month!

Many thanks stephen - presumably if our claim is dismissed that that's rather a bad development and if it is not then the process continues in the way that BIT arbitrations tend to. Would you mind clarifying - what am I missing?

Am I missing something here? All that is expected (not promised) in September is the tribunal's decision on whether or not to dismiss our claim in its entirety. Whilst obviously it would be good news if they do not dismiss our claim it doesn't finally determine the question - there can still be a full arbitration thereafter can't there?

Clearly we can all hope that magical news will be provided but is there any rational explanation as to why that would happen alongside this finding?

Well judgement time, anytime now.

Last time for the jurisdiction verdict they suspended the stock for the day when it opened it went CRAZY.

The directors all hold their large holdings, so do the big institutions. I wont get worked up about 160k shares you talking about at an average of 26p its around £41k. That's not much in the grand scheme of things.

I reckon you could take it if it was in the terms suggested by Stephen, which would basically mean a large payout.... :-)

FWIW I would love to see such an RNS, but don't think we will. I expect to see the judgement in the next four weeks or so, but wouldn't care to predict exactly when.

RNS 16.46.
"CHL and ROI are pleased to announce that agreement has been reached in relation to the misunderstanding regarding mining in the, East Kutai Regency. Full details will be announced at a later date, CHL Shares will be suspended from 08.00 of the day following this publication,"

We will see.

Well as we draw to the end of the pre-September trading, hopefully the next month will be a good one for all CHL holders.

At least we know there will be some news - good or bad is unknown, although we feel confident in CHL's case, such decisions do have a habit of surprising.
