Brinks Canada is pleased to announce that it has received a stay of direction related to what it believes was an improper danger ruling by a Labour Canada Health and Safety Officer (HSO). This stay will remain in effect until the appeal of this direction is concluded.

The HSO danger declaration, issued under Section 145 of the Canada Labour Code, relates to Brinks Canada’s use of the “All Off” Model for crew dispatch. “All Off” is a staff resourcing approach where work is completed by a two-person crew, where both crew members exit the vehicle and enter the customer site to complete their work. The crew members complete the work and return together to the vehicle. These crews are used primarily to transport goods to and from many of Brinks clients. The All Off model is proven in Canada, having been used by other competitors in the industry for over a decade. Brinks introduced its version of this model in the fall of 2015.

Brinks Canada has appealed this HSO direction. Brinks believes the decision is incorrect and the result of an inadequate investigation. Most importantly, it does not reflect the current definition of danger under the Canada Labour Code.

Following a series of telephone and written submissions, the Occupational Health and Safety Tribunal Canada granted Brinks Canada’s stay application on September 12, 2016. The result is that the direction issued by the HSO on August 18, 2016, will have no effect until the Tribunal has ruled on the appeal.
