Wal-Mart Stores Inc. (WMT) Monday said if South Africa's competition tribunal enforced conditions on its purchasing agreements for its proposed merger with retailer Massmart (MSM.JO) it would either appeal the decision or walk away from the deal.
Wal-Mart said it would make some voluntary employment promises but the legal team for the merging parties said: "We cannot accept conditions."
"It will force the merging parties to appeal the conditions or walk away from the deal if imposed," it added.
The tribunal will in the coming weeks either approve the deal with or without conditions or reject it following the close of the hearing Monday. Unions and the government are calling for the tribunal to require Wal-Mart and Massmart to make employmewnt and local purchasing requirements if the deal is approved.
Consensus among observers is that the tribunal will approve the deal with conditions.
