On February 6, 2009, Edward C. Miller, Jr. and Stephen Chalk, each then a member of the Board of Directors (the “Board”) of Able Energy, Inc. (the “Registrant”), notified the Registrant of their respective resignations as members of the Board, effective as of February 6, 2009.
