Mykrolis Requests Court to Hold Pall Corporation in Contempt
BILLERICA, Mass., June 21 /PRNewswire-FirstCall/ -- Mykrolis (NYSE:MYK)
announced today that it filed a request with the United States District Court
in Boston that Pall Corporation (NYSE:PLL) be held in contempt of court.
Mykrolis believes that Pall has defied the Court's preliminary injunction order
issued on April 30, 2004 that prohibits Pall from importing and selling certain
of Pall's photoresist filtering products or colorable imitations thereof. Pall
is continuing to sell its EZD-3 products, which are renamed versions of its
EZD-2 products, both of which Mykrolis contends are subject to the preliminary
injunction order.
The Court's April 30, 2004 preliminary injunction order enjoined Pall and its
affiliates from further infringement of Mykrolis's U.S. patents at issue in the
litigation, as well as from "making, using, selling, or offering to sell within
the United States, or from importing into the United States, the product now
being sold under the name PhotoKleen(TM) EZD-2 Filter Assembly, or any
colorable imitation thereof, until further order of this Court." Pall is
appealing this order from the Court.

the actions by Pall that prompted our legal actions are very serious. We intend
to continue to actively and aggressively pursue this litigation and to protect
our intellectual property rights. As part of these efforts we are requesting
that the Court hold Pall in contempt for not acting in conformity with the
preliminary injunction order."
