Super Vision Announces Intention to Re-File Infringement Case against Color Kinetics

Super Vision International, Inc. (NASDAQ:SUPVA), a world
leader in LED and fiber optics lighting systems, today announced that
the United States District Court for the District of Massachusetts
dismissed Super Vision's patent infringement complaint against Color
Kinetics Incorporated (CLRK), in which Super Vision sued Color
Kinetics for infringement of Super Vision's U.S. Patent No. 4,962,687
(the '687 Patent) previously acquired from High End Systems, Inc. of
Austin, Texas.
   Based on the terms of the dismissal, the Court stated that Super
Vision could still file another infringement case against Color
Kinetics, which it intends to do.
   Super Vision believes that the Court's findings of fact and
conclusions of law contain errors that would provide the basis for
successful appeal. However, instead of appealing, Super Vision intends
to review the Court's dismissal in depth and file another suit against
Color Kinetics for infringement of Super Vision's '687 Patent.
   Super Vision believes that the Court's ruling was substantially
procedural in nature and will have no impact on Super Vision's ability
to prevail on the merits of its infringement claims against Color
Kinetics.
