It says that in the section posted above and in this bit: "The Relative Prejudice to the Parties Supports Striking Hoodoo’s Response" "The Board should refrain from attempting to adjudicate the parties’ respective lease rights and should instead proceed to approve the proposed unit operations. Petitioners would be substantially prejudiced by waiting to expand their proposed operations beyond the four wells already approved until the conclusion of litigation that Hoodoo has yet to initiate. Hoodoo, on the other hand, remains completely free to exercise all of its leasehold rights outside the unitized formations. Maybe Valkor can afford to wait for this to be resolved albeit they are now well behind their schedule as according to their website as they intended to get the additional permissions sorted in Q1. As per other board, the file posted by rmart is only the advice from the board's assistant lawyer, it's not a decision, it's up to the board to decide at the next meeting. What she says, that was already put forward by her prior to the last meeting, as it was posted verbatim on the other board back then. . The Sullivan case has already been put forward by Valkor lawyers in response as below. Replace Sullivan with Hoodoo. . "The Supreme Court in Sullivan took a similar approach. Yes the Utah board has said that Hoodoo can't challenge the previous decision for the test wells made last year. 30/6/2023 11:45 | Interesting that there has been no comment from JP. Maybe he's run his course, though I doubt it. Though he has brought the company to ruin, one has to admire his chutzpah. With absolutely no experience in the sector or even in the country in which the company operates, he has managed to hang on for some 3 years, milking investors for increasingly rich paydays. How has he managed to do that? By latching on to Valkor and accepting Steve Byles' word as gospel, even though Valkor has no responsibility to Tom's shareholders. By extension, Byles has been able to control the board and the strategy (and purse strings!) of Tomco. JP's failures are already legend on this chat board, but the real failure is with a BOD that for 3 years has refused or been unable to access the expertise that might have steered it away from disaster. AIM is rife with oddball companies, but I can't think of another that has both a Chair and CEO (the only employee) who have no experience in the industry in which they are spending shareholders' money.
