All this talk of legal action is daft . Nobody was forced to buy the shares . Mining is high risk at the best of times, especially a company with only one mine and no capital .
Anyway , who do you propose suing who has any cash in the very unlikely event that you get anywhere ?

With Fridays court hearing now complete it is time to start looking to see if there are any possible legal options.

You got it schofip, they pushed the truth and the potential in all regards.

But the biggest misrepresentation was over the product, the trial results and the sales agreements.

It makes me wonder what potential AAL can see that others that know the fertiliser industry cannot. We will see after their 2 years of evaluation of the purchase.

The government could have taken a stake like they did with the banks in the financial crisis. It could be that the project is not as financially lucrative as everybody was led to believe and still has major risks to overcome. Evidenced by the complete lack of interest by major mining companies, investment management companies and venture capitalists. They obviously saw through the hype.

loan guarantees sound like an utter con.

if the company succeeds, the loan company makes a profit.

if the company fails, the loan company makes a profit from the interest paid to date, gets the priciple back from the government and the tax payer foots the bill.

Where is the upside for the tax payer taking the risk?

Loan guarantees are different though and are used in Europe to help fund big infrastructure projects.

The bottom line, and problem with govt guarantees, here is that Sirius is not a big infrastructure project. It is a big speculative mining venture where outright failure is still a risk and possibility.

No sensible government would guarantee that! (And in any case there is no need as AA have bought Sirius out and will fund this themselves.)

The government is still bound by EU rules regarding state aid to businesses.Even if Boris and Co wanted to buy in to Sirius their hands are tied until the end of the transition period.

I beleive that they have stated early April.

Of course you can still sell them in the market and get paid in a few days.

To those that thought that voting for administration was a bit of a wheeze, this is the consequences...for flybe staff, who sadly don't have a bidder standing ready to buy them.

Losing on a high risk investment is one thing, being dumped on the dole from a job you have had for years is quite another.

Clearly it would have been financially beneficial to AA to have allowed Sirius to go into administration, give shareholders nothing and pick it up for buttons out of administration, since they arnt a charity. Non investing local people would still have perceived them as their saviour. The irony is that if they had done that I am pretty sure the government would have stepped in and possibly provided loans. When we were in europe I think there may have been rules preventing that. Considering who the main benefactors of this sale are, and the high level of advertising targeted to a set of mainly local non experienced investors I think a public enquiry should be called and if deliberate misleading is the outcome a class action/criminal trial should follow. The main thing for the government now is to ensure this shenanigans doesn't happen again.
