That said, DRH and some others are relentlessly extreme in their views (either way - neither is helpful in my view). Where they run a risk of appearing credible then I will seek, using logic and evidence, to prove them wrong. 14/10/2015 11:32 | So, this whole UNCITRAL rules thing. Article 8 of the BIT ( provides for various arbitration options with a fall-back of use of the UNCITRAL rules. Typically an arbitration is run under the auspices of a particular arbitration body - let's say the LCIA. The LCIA has its own rules and a complete administrative set-up to go along with it (a list of its own arbitrators, a secretariat etc etc). UNCITRAL is different. As they say on their website ( "UNCITRAL and its Secretariat do not act as an arbitral tribunal, administer arbitration proceedings, or otherwise perform any function related to individual arbitration proceedings, or any other system of public or private dispute settlement." All UNCITRAL does for our purposes is set out the rules which apply. A sporting analogy would be very easy. We then have to find our own pitch, umpire/referee etc. The UNCITRAL rules ( themselves of course contemplate this situation and paras 24-27 offer a few suggestions as to how to proceed. I've not been able to find a clue as to which route we're taking of those suggested in the UNCITRAL rules. There doesn't seem to be anything in the Notice of Arbitration (hxxp://www.italaw.c It is the ICC secretary who would be in touch with the arbitrators who will have to write opinions, share them with each other, review them and comment on them, discuss whether any difference in opinion can be resolved or whether any of them have been swayed by others' opinions before finally settling on the versions which will be released. We could expect the secretary to give us guidance where that guidance is available. The fact that RS has felt confident enough to give the "very near future" statement in the interim financials RNS is a really good signal, especially bearing in mind his comments at the AGM about not wanting to but a timeframe on things ever again.
