[IMG] Share on twitter by Tess Ingram Australian miner Kingsgate Consolidated says it will move immediately to commence international arbitration proceedings against Thailand over the premature shut-down of its Chatree gold mine. After months of negotiations with the Thai government, Kingsgate said Thursday it had been unable to reach any settlement and would commence arbitration without delay to try to recover "the substantial losses" it had incurred. It is understood the compensation Kingsgate seeks under the terms of the free trade agreement between Australia and Thailand amounts to hundreds of millions of dollars. The Thai government shut Chatree on December 31, 2016 in the wake of a sustained campaign by local land owners and environmentalists, which alleged the mine caused a number of environmental and health issues. Kingsgate has consistently refuted the allegations and accused the government of unlawfully seizing the mine, which it had operated since 2001. Long-standing Kingsgate chairman Ross Smyth-Kirk said he believed the arbitration shaped as a major test of the Thailand-Australia Free Trade Agreement (TAFTA), which contains a range of provisions related to investment protection. "There is a definition of expropriation in the TAFTA agreement and this certainly fulfils that and so we want full compensation," Mr Smyth-Kirk said. "We have had our whole livelihood, our whole business taken off us. We can't operate so we definitely think we have a very good case." Kingsgate said in August that while the Thai government said it would not offer any monetary compensation it may be willing to provide "other meaningful benefits in consideration of the shut-down". "So far there hasn't been anything offered that we consider meaningful benefits," Mr Smyth-Kirk said Thursday. Mr Smyth-Kirk said Kingsgate could consider restarting operations at Chatree, which is under care and maintenance, if it could negotiate better compensation and operating conditions with the government. He estimated a re-start could take three to five months and cost in excess of $50 million. Kingsgate said it had appointed law firm Clifford Chance and senior counsel Andrew Bell. The arbitration is likely to take place in Singapore. The arbitration could be lengthy, costly and an outcome was uncertain, but it would allow the parties to continue a dialogue, Kingsgate said. Minter Ellison director international trade David Morfesi said the dispute resolution process was important in supporting global investment. "Investors state dispute settlement is a significant tool in encouraging foreign direct investment between trading partners by ensuring that the regulation of those trading partners as it effects their foreign direct investment will be done in a transparent manner and not in an arbitrary way so the investors will have fair and equal treatment, and equal to that of nationals of the country where that investment is made," Mr Morfesi said. The Sydney-based company is also expected to appear in the New South Wales Supreme Court on Friday in a separate matter against insurers, including Zurich Australia Insurance, which it says have denied it a claim under a $US200 million political risk insurance policy. | geoffsh | |

A rough calculation that we have cash of around £6m post GGP warrants liquidated, direct investments of around £6m between MOD and Kingsgate. Thailand worth around £8m ( could be £12M Plus ) which almost mirrors our current market cap. Assuming the PFS is at least as good with Measured resources and Indicated providing higher degree of certainty the NPV should be around $300m or $90m to MTR. Assuming discount of 50% on NPV the Sp should be at least 5p. Strong and experienced management, no debt and huge upside. If Assays continue to prove up resource and Copper price continues to firm as many predict end of December should see a significant rerate. | gloucester rugby | |
