This action has been ongoing for a while I beleive. Very odd though that it has never been lodged in either the UK or the EU.
As you can see, it has to do with fuel surcharging.
Sadly, only applies to US citizens by the look of it but it is unusual for BA to agree settlements in cases such as this. Historically they don't from what I can see.

I wonder if this will encourage a similar claim in the UK or EU ?
