We assume a 2% to 12% EBIT downside risk on BATS and 1% on IMB, depending on the % of current menthol smokers switching to non-menthol cigarettes and the menthol consumers’ loyalty to its menthol brands.

Overall, we assume a 90% switch (10pp loss to NGP menthol products) and consumers loyalty to the brand given all of BATS’ menthol brands have non-menthol versions which would help mitigate any decline in usage. Note that at the time of the 2013 “menthol fears”, Lorillard derated by 10% vs. US tobacco.

The agency gives manufacturers the opportunity to curtail by themselves the youth nicotine uptick as it concedes that a ban of ENDS would deny the opportunities for current smokers to switch from combustible.

Yet in the absence of results, the FDA has the power to eliminate any application enforcement discretion to any currently marketed ENDS product (i.e. products would have to come off the market pending FDA authorization through the PMTA pathway).

By and large, the main manufacturers have already announced actions to limit youth access or curtail flavor offerings.

Hi bt, not atm, am tempted. Have held previously throughout the years.
Safer than BATS, and better run, however the dividend % increases are too aggressive
Imv, better to pay down more debt.

Bought a small amount of Lloyd today and yesterday fwiw,
but that could see 50 if this choas continues.
Good time to have cash on hand.

tighting restrictions may be helpful.

Remember just a few years ago blu was the clear market leader in vape stateside.

Statement re FDA announcement -

We welcome the US Food and Drug Administration's (FDA) moves to prevent youth access to tobacco and vapour products. We share the same concerns and objectives as the FDA: the use by minors of these products is completely unacceptable. Vapour products are for adult smokers and their sale to anyone underage should be prevented. However, we also recognise the challenge faced by the FDA in balancing concerns regarding youth appeal and access, given the positive public health potential of vapour products.

We believe that through our blu product range we offer adult smokers a significantly better alternative than combustible cigarettes and consistently reinforce this message, while at the same time working actively against youth access to, and usage of, our products.

On the FDA's specific actions, we welcome its commitment to standards for effective age verification for all online sales of vapour products; a technology which we already use on blu.com.

We recognise the FDA's concern over age verification at brick-and-mortar retail outlets and will consider further appropriate actions. The availability of quality vaping products like blu in outlets where tobacco products are sold is vital to help adults transition away from combustible tobacco.

We are developing a connected version of myblu with device locking technology and are greatly encouraged by Commissioner Gottlieb's comment on a process to accelerate development and review of vapour products with child protection features.

FDA restricts sales of most flavored e-cigarettes to curb 'astonishing' surge in teen vaping, pursues menthol ban


The Food and Drug Administration will restrict sales of most flavored e-cigarettes to stores that prohibit minors altogether or include sections that bar minors.

The FDA will also pursue bans on menthol cigarettes and flavored cigars.
Juul, Altria, Imperial Brands, Japan Tobacco International and British American Tobacco submitted their own plans to the FDA for curbing youth use of their e-cigarettes.

PHIL I took a few BATS tonight just before close I just couldn't resist.
