19/2/2018 08:23 | I found this posted on another Bulletin Board almost implying further hurdles at the Supreme Court even if we jump this hurdle Judicial Review 25 Jan '18 The following is now circulating on social media, It has been reported widely that the Judicial Review in the high court in 2017, of the decision to grant planning permission for underground mining at Cavanacaw by the DOE, (now the Department for infrastructure) had been unsuccessful, however outstanding issues remain. Although the Judge so far has decided not to quash the planning permission, she did confirm that the removal of a vast quantity of rock by up to 145 trucks per day on country roads in 2008 which devastated local residents was indeed unlawful, concurring with what the Ombudsman had found in 2012. The Ombudsman confirmed that the Department in respect of rock removal had: £failed to take appropriate timely enforcement action£ and concluded that the Department had demonstrated £a complete failure to protect the public interest£. In her Judgement the judge concurred with the Ombudsman confirming that £this activity amounted to unlawful EIA development£, finally putting to rest 10 years of claims by certain goldminers that this activity had been lawful. The efforts of a small number of residents determined not to be walked over by a mining company would appear to have been hugely successful: £ Truck numbers leaving the mine, at one time up to 145 per day on any road they chose, have been reduced to 9 per day on an agreed route. £ No trucks will be permitted at weekends, or before 9am weekdays to protect school children. £ Blasting velocity limits have been reduced from 10mm/second as applied for to 6mm/second, thereby reducing the level of noise and vibration experienced by people living close to the mine. With regard to the underground mine approval going forward there are as yet unresolved procedural issues concerning environmental regulation and the approved area of the site, which will need be dealt with at the Court of Appeal in Belfast in February. Simply put, we cannot allow a situation where a planning authority can grant planning permission for mine sites far larger than were applied for or properly assessed for environmental impacts. If we are to have a goldmining industry then it needs to be a goldmining industry which is properly regulated by a planning authority fit for purpose. Legal benchmarks set at Cavanacaw have the potential to affect a great many people in this country as well as impact on the environment. Prospecting licences for precious metals have now been issued covering large swathes of the province, with further applications for gold mining almost inevitable. These are now matters of national importance which must be ironed out, hopefully in Belfast next month avoiding the need to involve the Supreme Court in London, where currently some other Northern Ireland environmental disputes seem to be heading | boilandgas | |

Don't forget this is just the hearing to grant an appeal or not and if the former and if it is relatively simple, that appeal can be heard immediately hence why it may continue tomorrow. 01/2/2018 09:48 | From the court listings it appears the hearing on the 6th Feb is to consider the grounds for an appeal. So there must be quite a high chance that the appeal will be dismissed as the original ruling was very comprehensive. Also apparently, if the appeal grounds are relatively straightforward they can be heard straight away and a decision reached.
