22/4/2013 15:59 | Well, says Vince Cable our 'esteemed'* Secretary of State for Business, Innovation and Skills. Who knows where that figure comes from or how meaningful it is? It is simply not true to say "For the first time if pubs feel they are being treated unfairly by their landlords they will be able to complain to a powerful new body." Like any other business tenancy, pubs are subject to the Landlord & Tenant Acts and have been able to apply to the Courts to set their rents on lease renewal if they are unable to reach agreement on terms. Similarly, at rent review, there is an arbitration procedure written into the lease if agreement cannot be reached. It will be interesting to see where the 'Adjudicator' sits in amongst the existing legislation. Clearly, the new plans go beyond the existing system in looking at beer pricing and supply in addition to just rent but, of course, the cost of tied beer is supposed to be taken into account in assessing the rent anyway. All Government attempts to meddle in this industry have ended up following the Law of Unintended Consequences. I have no doubt this will be much the same. * not esteemed | jeffian | |
