The outcome was I have numerous options to continue with various actions, which I have alluded to above.

As you know there are civil court and criminal courts.

But regardless of above there are different options against different persons as well.

I know all this seems double Dutch but the legal system is ever so complex and I am still learning more as I go along.

To be honest with you even the Judge had to be corrected today having given me the wrong option going forward and had to be corrected.

This must happen quite frequently that is why there are so may level in the court system to overlook mistakes by lower courts.

I need a particular higher Judge to go one step further and I have already told the Judge I will be dealing with that aspect.

Not all judges can deal with all any matters if get my gist. However apart from that other authorities may take actions themselves.

There has been more and more wrong doing while proceedings have progressed so more and more avenues open to me to go forward.

Last but not least various authorities can take action despite what I may be doing next. I know this may sound confusing but the police have a duty as well to take action when they have evidence of fraud.

So despite what I may be doing next other authorities may take action as well.

Yes litigations continues, the Judge has already opened up new avenues of approach.

With the UK appeal system it never ends until it reaches its final destination, which most will know now is the Supreme court and the European Court of Human Rights.

However there are other recourses as well being the criminal courts.

As I indicated over the weekend if anyone had have gone to the court today, they would have heard evidence in relation to deceit and fraudulent conduct by various parties including barristers. What was also heard was allegations of contempt of court.

When I took action previously the Vice Chancellor told me it could be taken again.

You appear to know the law in respect of these matters, you also know its wrong to promote the company to selected shareholders.

All shareholders must have the same information.

If a company does not comply with the law shareholders can seek recompense.

Sorry to say that Keith took ekt to the brink of collapse and as we recovered his decision not to promote our company meant he could load up with millions of shares at shell like values and he has now made 10m pounds for himself at our expense He has played a blinder and in chess terms it's check mate to Keith In tennis terms he is game set and match In football terms he has won the quadruple The dismantling of the Jsop meant he could invent the most lucrative LTIP and share scheme for himself and Wilson and NOW there is no looking back as he is promoting the company like never before with at least 3 institutional buyers..something that has never happened before Well done Keith,you are a genius and you are the winner

Tilly,

For the sake of some clarity, its not just the courts but other authorities obligations in respect of my litigation.

There are issues before the court in respect of deception by Keith Daley & ORS which may well end up at both the Supreme Court and also Brussels.

However the recent ruling by the Supreme court places the onus on other authorities as well in relation to properly investigating fraud by deception.

Put it this way the police must now investigate all crime and this must do so efficiently. Once they have obtained all of the evidence its then up to the Crown Prosecution service to decide whether or not its in the public interest to press charges.

Bit most importantly if there is evidence of criminal conduct a police investigation would take priority.

All I can tell you at this moment in time and which is in the public interest is my action is multi faceted.

I am seeking the courts comply with the European Human Rights Acts and also seeking at the same time the police and or FCA comply with their duties.

All these arguments are to be heard next Tuesday before a Chancery Judge. One of my priorities of course is seeking a criminal investigation not be compromised in any manner and evidence of deception and fraud be dealt with as speedily as possible.

It is not unknown for the police to bodge up an investigation, and with the Supreme Court Judgement it means the police will have to take more care in their investigation in future. In fact they will have no option but to leave no stone unturned in respect of serious crime. The reason it went to the appeal court is the police know its going to cost them in resources. but justice must be served and common sense has prevailed in the end.

From reading some of the articles in the press solicitors are already pressing ahead with further claims following the recent Judgement.

I have to be careful what I say at this stage, however litigation must run its course and it may well end up in the Supreme Court and also before the European Court of Human Rights.

I would hope before that stage however that the courts due take action and or the police and FCA do also in order to protect the company and all past and present shareholders.

The recent Supreme court hearing has major ramifications both the State and the police and other authorities for that matter must comply with that Judgement.

Furthermore the final say would be the European court in Brussels.

The police losing their appeal before the Supreme court opens considerable arguments the court has to consider. Lawyers are already using the Judgement in respect of new proceedings and the current litigation will refer to the same judgement.

Where the police have failed to take action previously they must do now. In fact the police must investigate all crime but the recent judgment enforces their obligations in respect of certain crime.

This is why the police were dreading losing the appeal.

Simon Keith and John won't fancy travelling to Brussels to face you in the courts!!The loss the Jsop lost on selling 10m shares to Keith at 5p is that a loss for shareholders Simon? There were no sellers at 5p so why did shareholders have to take the loss?

There would be no court cases if there was no arguments in law!

But I have got a hearing on Tuesday and litigation continues.

This is why we have a Supreme Court and also the European Human Rights to seek that justice be served.

Its not unusual for courts to make errors on the way it conducts cases and or an explanation on the law be required to be looked at by a Higher Court.

You mean the court hearing?

In Liverpool before a chancery judge at District court in Vernon St. However there may be some restrictions as to who can attend due to the seriousness of some of the issues. Some of the matters are highly sensitive and there are confidentiality issues the court will have to consider.

The long-term incentive plan has drawn criticism from the City and politicians.
Based on yesterday’s closing share price, chief executive Jeff Fairburn has agreed to hand back around £25m of his potential £99m bonus, while chief financial officer Mike Killoran will give back £24m of his £78m payout."

Too buys now with litigation just took a break, so I cannot comment further apart from saying if they had not handed back some of their bonuses they could have faced legal action and possibly prosecuted for fraud.
