If you refuse to disclose your identity, then we will seek it by Pharmacal and show to the court that you stated you were willing to disclose your details, but the moment we asked for them, you refused to provide it. We will seek to impose the (considerable) costs of this Pharmacal on you alone. It's your intrasigence that will cause you financial loss.


The above person was advised months ago that I would consider his request subject to several conditions and safeguards. However, the subsequent e-mail I received did not even specify which individuals were making a claim, the nature of any claim to see whether any complaint was likely to have merit - or provide any information or assurances as to what purpose the details would be used for.

Given this and the previous disregard for the correct protocol, naturally I declined to pass my details on and I still refuse.

It seems from the threats that more than one individual wishes to pursue me through the courts. Therefore, those other unnamed individuals,(if they exist) if they identify themselves here and validate their details and provide a brief summary of their claim, I am willing to consider any such request. Needless to say, I will not be providing details to those whose complaints are regarded as frivolous, vexatious, or clearly having no merit. In addition, I will be requiring assurances regarding any information handed over.

May I remind you that if any claims relate to alleged defamation or slander that there is a one year limitation period. Therefore you had better pull your fingers out and start the necessary protocols.

Is it me or is there a distinct deterioration in the behaviour on this site in terms of people trying to line their own pocket at the expense of others?

I can cite numerous examples lately and also detect a total disregard by some people for other individuals who post here and people generally.

Perhaps it is just me. I suppose its down to the fact that I am now the new undisputed Corporate Cruscader on the block.

More fun and games at Deo Petroleum, the cash shell which is looking for oil and gas investments.

Last week its shares jumped sharply, forcing the directors to put out a statement saying they knew of no reason for the rise, and there was no material information which was not in the market.

Today a post on a bulletin board included an announcement that the company had made a major discovery in the North Sea (this is an investment company, remember with cash as its only asset so far.) The contacts on the statement were genuine, but the date was 13 January.

The company was forced to issue another statement immediately, condemning the announcement as a fake, and repeating it had nothing new to report. Sources suggested a disgruntled investor may have bought Deo shares last week after their rise, and when they dropped back today, decided to do something about it by making a fictitious statement.

Fortunately the fake appears to have been rumbled at once. The Aim team have been told and are believed to be looking into the matter.

Whatever the case, investors in Deo have seen the company's shares drop 42% today to 2.875p. At their peak last week they touched 7.125p

This is quite interesting. One of the directors of ORB (Peter Catto) who was under investigation, seems to have been a director of Netvest - the previous name for London Asia Capital. Tragically, it seems he died a few years ago.


Orb Estates, Quays Group & the Takeover Panel

Solicitor Nicolas Greenstone, a former partner of Fladgate Fielder, has been reprimanded by the Solicitors' Regulation Authority for his professional misconduct in relation to Orb Estates and Izodia. Here are some quotes :

Solicitors' Regulation Authority: "...Nicolas David Anthony Greenstone has acted in breach of Rule 1(d) and (e) Solictors' Practice Rules 1990..." Full report

Legal Services Ombudsman: "...Mr Greenstone was guilty of an extremely naive error of judgement and an act of foolishness in trusting his associate Dr Smith with a signed document to do with whatever he wanted to do..." Full report

In August 2002 a group of shareholders in Quays Group appealed to the full Takeover Panel (the City regulator for takeovers and mergers) to try to stop Orb Estates' reverse takeover of Alexanders. We presented a wide range of concerns concerning the web of offshore Orb companies, and the dishonest statements which Orb and its associates had made to shareholders and to the Panel. The Panel dismissed our appeal on 15 August 2002.

The Serious Fraud Office took a less tolerant approach to Orb's varius frauds than that of the Takeover Panel. In 2005 charges of false accounting, theft and conspiracy to defraud were brought against three Orb defendants. On 11 September 2006, Orb director Gerald Smith was sentenced at Cambridge Crown Court to 8 years imprisonment for his part in the fraud. Charges against the other two defendants, former Orb associates Peter Catto and Jar Vahey, were left on file.

Not the same Nicolas Greenstone who worked for MHG?




Former Fladgate corporate head Nicolas Greenstone has been reprimanded by the Solicitors Regulation Authority (SRA) for actions that led to a £27m fraud.

Greenstone, who left Fladgate in 2003 and who now works for Merchant Capital, was admonished as, although his conduct was not fraudulent, it allowed others to implement a multimillion-pound deception.

While ;at ;Fladgate ­Greenstone acted for Jersey company Orb, which was being investigated by the Serious Fraud Office after millions went missing from dotcom Izodia. The cash allegedly had been transferred to an Orb subsidiary.

Prior to this Greenstone signed a pro-forma that led to Izodia director Dr ­
Gerald Smith fraudulently ­transferring money from the dotcom to Orb.

Greenstone was reprimanded as he did not have the authority to sign the document because he was not the company secretary.

The case was referred to Legal Services Ombudsman Zahida Manzoor after a shareholder felt that the SRA did not go far enough. Manzoor did not believe that further action should be taken.

Fladgate declined to ­comment.

So JH - MHG director was also director of Microcap Equities plc and then the company changed its name to DEO. Will check whether he is still a director.

There is an interesting a character by the name of Nicolas Greenstone was formally appointed to work for Merchant House Group and looks like he is still a director of DEO.

Background:

Nicholas Greenstone serves as Chairman and Secretary of Microcap Equities PLC. Mr. Greenstone served as Chief Executive Officer of Niche Group PLC. He served as Chairman and Director of Azure Holdings plc. He served as Director of Niche Group PLC until August 31, 2006.

Now Azure Holdings - was that not Room Service Group before it changed name?
