20/4/2016 19:52 | Only a court can enforce anything on a Sovereign Nation. Sovereign nations have many tools at their disposal. This case is about bs company taking on a G20 country. Like I said it will end in a court and a court may not take the same position; a court can go more technical and the Indonesian defence team can show $1bn claim has no validity and on that basis it will be dismissed. Hope this helps | bad robot
20/4/2016 19:49 | What the Russians are saying is it never should have got as far as International Arbitration since the treaty hadn't been ratified. Very different story here, I believe. | bones30
20/4/2016 19:49 | hi agentx11, "IF CHL had a case, they would have taken redress via a court directly." If you had bothered to check the history of this dispute, you would not have asked that question. | stonefold
20/4/2016 19:45 | Arbitration is a method of resolving disputes by a binding and enforceable decision. Arbitration requires consent. You may agree with your business partner to have your dispute decided by one or more arbitrators instead of taking your dispute to a national state court. There are different types of arbitration. They range from large, formal proceedings between states over a disputed boundary to short, informal procedures about the quality of goods under the rules of a trade association. The procedure and the reasons for choosing it depend on the type of dispute concerned. What all arbitrations have in common is that the parties must agree to the process and that they result in a binding and enforceable decision. | bones30
20/4/2016 19:44 | Hi Nav....there is obvious risk, you need to figure out what your risk appetite is. I suggest you stick to ftse100 might be safer and you will sleep well. | spartikas
20/4/2016 19:43 | The case about Russia shows, ultimately in any big claim, it's a court that will decide. Arbitration verdict is non-binding, if people do not know this. They are just mediators and if participants are not happy with it, then the next stage is the court. Hope this helps | bad robot
20/4/2016 19:41 | how many times have a court upheld $billion claim? CHL is already on life machine now | bad robot
20/4/2016 19:38 | agent x11 20 Apr'16 - 19:31 - 3314 of 3315 you asking right questions, like me i want to know. Their no point ramping up a stock without hearing both sides. | nav1000
20/4/2016 19:37 | Very different scenario I believe: "In its argument on Tuesday, the Hague district court said Russia had never ratified the energy treaty under which the PCA had based its case." | bones30
20/4/2016 19:35 | spartikas if by the assumption of chl and shareholders here, The indonesians have lied and mislead the panel. What makes you sure they will play fair afterwards. Lets say hypothetically they are awarded money, Indonesians will fight this at the high courts which will further cost chl millions. Where are they planning on getting millions from? They only have this asset, dilution after dilution... | nav1000
20/4/2016 19:31 | According to that article, the arbitration has no power for enforcement and it will definitely be challenged in a court of law if it's against Indonesia. Clearly CHL is desperate paying Indonesia share of costs. Indonesia does not care anymore what the Arbitrator says, they will defend the case in a court. IF CHL had a case, they would have taken redress via a court directly. | agent x11
20/4/2016 19:25 | Nav100 you have only here for one day and are now spouting utter rubbish. | spartikas
20/4/2016 19:23 | arbitration panel can recommend what they like, but will Indonesia play ball with any settlement. | nav1000
20/4/2016 19:21 | I thought open house was only on Thursday night? pembury 20 Apr'16 - 17:09 - 3294 of 3310 1 2 f me filter quick! | bad robot
20/4/2016 19:13 | Bad Robot I can guarantee CHL will not be getting $1.3b. This whole process is a long haul, its already been 5 years and i can bet chl will be happy with £100m. But this will probably take another 5-10 years. $10m-$15m has so far been spent on this case, how much more will it cost? | nav1000
