I think that Chris Mills is looking at the North Sea business and can see that it's gaining traction. The Dundee facility came into operation in June last year; revenues grew by 50% but it doesn't make much money as it's still sub scale. He and the management can presumably see the pipeline and know what's coming. I guess, he's also thinking that once the market shines the light on the North Sea Decomm opportunity, this will be a more valuable company.

Well if they're fighting it they're hardly likely to publicly admit that they owe the money are they.

I can't for the life of me see what Chris Mills likes about these. They never seem to make any money, they're not an asset play, they don't pay a dividend and if HMRC win things are only going to be worse.

But what do I know, Chris Mills is pretty shrewd and the management should know better than anyone what it's worth.

Re landfill tax, this is from wikipedia and I'm wondering how HMRC set about verifying this, short of digging up the waste and checking. I can see how an operator could seek to win council business by collecting it as one category and disposing of it as another. Given that this requires self certification and it is unlikely the HMRC will come and dig up land, the temptation to cheat must be considerable. And so one is relying on the integrity of the management team.

"The amount of tax levied is calculated according to the weight of the material disposed of and whether it is active or inactive waste.

Inactive waste covers most materials used in a building's fabric as well as earth excavated for foundations. Most forms of concrete, brick, glass, soil, clay and gravel are classified as inactive.

Active waste covers all other forms of waste such as wood, ductwork, piping and plastics.

Inevitably there will be some mixing of waste such as inert bricks and concrete mixed with small amounts of wood or mineral dust packaged in polythene bags. It is for the producer of the waste to decide what is reasonable and acceptable in terms of active waste contamination of inert waste.

The landfill site operator is responsible for paying the tax and will pass the cost on to businesses and local councils on top of normal landfill fees."

woozle1 - the tax will all be paid at once. Augean did not pay landfill tax on waste they say is exempt and/or at low rate they deposited in or close to their landfills, HMRC say it should have had tax paid at a different rate.
It sounds like its going to tax tribunal and possibly higher in the courts. If AUG lose then the tax bill will apply to all the wastes in those catgeories up to the date of the decision so will come as one big payment AND as importantly going forward to all the waste they want to take in. HMRC have to issue formal demands close to 4 years old as otherwise Augean can claim it is disallowed purely on time grounds which is clear in their RNS

Mr Market, and the directors, seems to think there is no tax to be paid or it will be at lower rates than HMRC have asked for. If they get lower rates than the full demand then what does it mean for all their business going forward as from the waste producers point of view they have to pay the extra tax on top of the disposal fee as its the total cost thy focus on as no one can claim 'back' landfill tax. So customers will look at other treatment plants/ methods/ operators imho.

Augean have a reasonable reputation and are generally well run so at least this is all buying them time to prepare for the different outcomes.

I'm not sure this tax situation is big deal because if it does go against them it is clear that it will be for much smaller amounts (the first summons has been drastically reduced) and it will be spread out over time (as these summons are spread out over 4 years)/

IF...the tax situation goes in their favour - they're worth a fair bit more than 55p IMO, but it's a big if obviously.

Maybe it is technical Woozle1 but if the tax situation goes in their favour and looking at the chart we could be heading straight back to the 55p range,,,,,,time will tell :-)

I think it's just technical and it will probably fall back. In the short term this stock is worth 60-70p on a p/e of 10 and once it starts growing again (I think North Sea decommissioning could be a big business here) it will march onwards.

I'm in this for 5 years at least and expect to make 10-15 times my investment. Chris Mills is rather good at these situations. He bought in Telecom Plus and RPC at v low levels and in both cases the stock went up by more than 10 times.

I tried buying 100k shares when the market was 34/5 and was told that I'd have to pay 36.5. So I've so far managed to pick up 100k by buying 50k units at 35 and limiting the order at that level.

The other good news is that the boil has been lanced and all the bad HMRC news is out there.

If Chris Mills and the CEO are buying PA that's a good a sign as any.

Two pieces of good news for me today
The first is they have given a reduction on more assessments since the prelims-albeit not as steep as for the first batch and second is that over the four year period for South and 3 ¾ years for North the annualized sum is just over £9m ie less than I had anticipated.
I have not plucked up the courage to buy more yet.
