Karen Murphy has paid nearly £8,000 in fines and costs for using the cheaper decoder in her Portsmouth pub. But she took her case to the European Court of Justice (ECJ). It found partly in her favour, and now the High Court in London has also found in her favour. However, the Premier League said it still had the right "to prevent the unauthorised use of our copyrights". The complicated case has been closely watched as it could trigger a major shake-up in the way football TV rights are sold, and potentially pave the way to cheaper viewing of foreign broadcasts for fans of top-flight English games. However this must just introduce a tiny element of risk if there are any racing bodies raising concerns. Happy to be corrected though ... Looks like the Reubens have done a good deal here. I think this is another example of what will be a growing trend, namely the "low premium takeover". Liquidity is getting so valuable in today's world that strategic holders of large stakes (such as Hemmings in ARE's case) are happy to realize their asset at a 10-15% premium so that they can go and spend it before it's too late. The shennanigans of Joe Lewis at MAB is another example of a billionaire being unwilling to pay much of a premium at all and I suspect he will achieve his aims there too. It's pretty unethical but if the market is unwilling to rate shares properly then hard-nosed rich businessmen will take advantage of the situation, take a longer term view than the market and capitalise to the detriment of the small guy. 18/1/2012 09:10 | The share price is marginally below the agreed bid price. Clearly, many shareholders are selling now as solely a marginal call to get the money now rather than wait two months. Furthermore, I suspect that the R Bros are mopping up all the shares on offer. This game is over - there clearly is no expectancy in the market for a counterbid - otherwise the share price would be creeping above the bid price. | 25babies | |
