If Patch is right and there is just a small hold up with the loan notes, which Volantis are not planning to convert and have convinced the takeover panel that they will not have effective control, then by lunchtime Monday, the RNS which under rule 11 should have come out on Thursday or before, will be out. Those who sold on Friday because they had read the death spiral RNS as written "the first drawdown is 1 Mar" and could see it was subject to mutual agreement, have a complaint against the company and Nomad for breaching rule 11. I still can't work out why ADL and Volantis would structure the deal as a death spiral with obvious implications for the takeover code, which the ad doc made clear did apply, though until recently the website did not. Maybe nasty Beaufort talked them into doing it that way and the Nomad was just asleep at the wheel when they signed off on it. If I am right, then all those who would have been buying thinking the takeover code does not apply and the company is solvent can thank me. If this is the case then the company was going bust sooner rather than later anyway, I may have brought forward the inevitable, but that is all. If AIM Reg do not act and there is no RNS next week, then the proper authority who should be made aware of companies potentially trading whilst insolvent will be made aware. By then it will be crystal clear there is a major problem, as the RNS saying there is no problem would have been out long before. All I want is for AIM to clean up its act and start enforcing its own rules properly for the good of all investors and the UK economy. Far too much money goes down the drain keeping dogs like ADL alive. That money should be going to decent small companies with genuine prospects, who can abide by the basic rules. If more dogs go earlier to where all dogs eventually go, that is a good thing not a bad thing. Shareholders can not complain they have not been warned and if Nomads did what shareholders pay them to do, there would be no need for people like me to do the job for them. Not that I would get a chance, as I have done nothing wrong, but I would be happy to explain that to a judge or any other so called authority. Enough is enough, AIM clean up your act! I can't police every dog share on the market and have to pick the worst offenders. Quite a bit more research has to go into what I do than simply buying or even shorting. I believe in what I am doing, it is for the good of all and I am happy to continue putting in the effort until it becomes unnecessary, because those who should be doing the job they get paid to do are doing the job. I get no monetary reward for what I do and I do not want any. The thanks I get from people whose money I have saved is reward enough. Finally I would like to thank Patch. If it was not for him insisting the takeover code did not apply and pointing me to the erroneous statement on the ADL website, I would not have thought about contacting the takeover panel. Well done patch! You are either right and now everyone will know what is going on and can make properly informed investing decisions or you have sacrificed your own investment for the common good, so take that as consolation. | sweet karolina | |
