A Garmin Ltd. unit said a judge at the International Trade Commission issued an initial determination that asserted patents by Koninklijke Philips NV and its North America subsidiary were invalid and didn't cover Garmin's wearable devices.

The ITC last month said it started an investigation into certain wearable monitoring devices in response to a complaint filed by Philips in late 2019. Philips's complaint alleges the infringement of certain patents and violations of section 337 of the Tariff Act of 1930 in the importation into the U.S.

Other respondents in the investigation are Fitbit Inc., Ingram Micro Inc., Maintek Computer (Suzhou) Co. and Inventec Appliances (Pudong).

"Philips is aware of the initial determination made by the International Trade Commission in the context of its investigation into the infringement by Fitbit and Garmin of Philips' patents," Philips said. "We are studying this decision, as we determine our next steps. Moreover, as separate to the ITC investigation, litigations related to other patents are still pending between Philips and Fitbit and Garmin, we will refrain from providing further comments."

An ITC spokeswoman declined to disclose the full initial determination, citing confidentiality, but noted that initial determinations are subject to review and the final determination for the investigation will come on June 4.
