This has nothing to do with the outcome of the referendum, but whether, given the impact on existing statutory rights dependent on continuing membership of the EU, the Government can terminate membership without recourse to Parliament.

my guess is that all key legislation will need to be debated and voted on.
May and co.wanted to repeal the lot in one go then start again.
It will take years if the judge makes the ruling in favour of parliament.

The Guardian corrects me ...


In order to prevent leaks of the market-sensitive ruling, which involves a large number of parties, preliminary drafts of the judgment have unusually not been sent out in advance to the lawyers.

As appears, it is a "hand down" Judgment, which has been embargoed until 10.00am. So the result will hit the wires on or very shortly after 10.00am.

Either way it will very probably go to the Supreme Court. If it does, it will be argued there quite quickly.

The appeals process can move very quickly in important cases requiring speedy resolution.
