Would be ironic if the Russians and Uzbeks used Trident to take out the British Oxus.

Wulber. Who is gail rowbotham? I think this post by football supporter might be correct, unless gail has just plagiarised stephen1946's ideas.

To all you conspiracy theories out there I can confirm that stephen1946 has NOT been abducted by aliens. He has just had 'the op' and come back as gail rowbotham.

"The chances of 4 may well be only 50/50."

That's your opinion, rossannan, but not mine! I still believe that OXS will win and the OXS share price will multi bag from the current share price. Whether that gives a 12p, 16p, or 20p sp, or even more, we'll have to wait and see. There are so many variables that it's impossible to give a definite target share price assuming OXS win.

Great posts from Gail on the other thread:gail rowbotham - 30 Oct 2015 - 12:20 - 719 of 727 - 0the keywords here are, expropriation and misappropriation. If the latter is proved as correct, then all the gold mined since expropriation belongs to OXUS not Uzbekistan, and that is easily quantified.Then you come to, what percentage of gold can AGF produce in the future.That's just 1 mine, this award is going to be huge, and RAB also appear to take the same view. Will buy a few more shortly, I cannot believe more investors/gamblers haven't yet piled in, most certainly the chance here to make quite a number of ordinary people, very very Rich, and I wish them all nothing but good wishes and a hearty toast with a Bucks fizz.gail rowbotham - 30 Oct 2015 - 12:42 - 721 of 727 - 0FWIW, In my opinion precedents wont apply to something like this Grand larceny, this is a quite extraordinary situation, that's what happened, grand larceny.A sovereign state, land grabbed, OXUS property.Precedents may apply to the award inasmuch as "how much can sensibly be awarded in light of what happened".Huge award coming. RAB think so as well, imho.gail rowbotham - 30 Oct 2015 - 15:59 - 723 of 727 - 0Rossannan, fully appreciate where you`re coming from and re Venezuela, quite right.On this occasion though, Uzbekistan stole the mine and then carried on mining as if possession was indeed 9/10th of the law, and the uzbeks owned the mine, going as far as to sell on the "stolen gold". That's got to be a first.gail rowbotham - 30 Oct 2015 - 19:17 - 726 of 727 - 0you`re right rossannan, from 5mths after the agreements were signed, the creeping about, questioning data, then altering VAT NONE PAYMENT agreement that was written in at the start of the contract, then the local gestapo going in and searching for evidence to cancel the contract to mine and all through this OXUS GOLD kept to their word and paid millions for extraction equipment and staff plus a gold processing plant.Then it appears the Uzbekistan gov. Discovered that the ore was pretty close to 99% pure Gold, from that point the oxus employees became fair game and 1 was and still is, imprisoned.Rossannan you make a lot of sense, not enough posters know about the 99% purity and that aspect is critical in the Tribunal deliberations.As is the fact that sometime ago , (8 mths) Russia added 2k oz of gold to its reserves, and, more to the point the seller was, "unknown" I think it was Uzbekistan and that is the smoking gun.>

Well I jumped the gun today. A breakout today never happened. The Cup & Handle pattern didn't form on the closing prices chart. Might have to await an RNS.

"Worth noting the company is valued at 28M on a 50/50 punt."

I have the odds of success for OXS higher than 50/50, john henry. Why? Because of this from the Calunius web site:

"litigation-funding

Litigation Funding Assessment

The main ingredients of a fundable claim are that:
•The claim should have good prospects of success against a solvent defendant; and
•The claim value should be for a sufficient multiple of the likely costs. For example the claim should normally be worth at least 6 times the costs of pursuing it all the way through trial. There are no upper limits in terms of costs or the quantum of damages.

Breaking this down a little further, Calunius Capital will assess potentially investable cases on a variety of factors, principally:
•Merits – What are the strengths and weaknesses of the legal arguments and of the supporting evidence?
•Quantum – What level of damages is likely to be achieved on success at trial or on settlement?
•Recoverability – Is the Defendant good for the money?
•Time – How long will it take to achieve resolution, including the risk of appeal?
•Costs – How much will the Claimant’s costs turn out to be; what is the risk of over-run; how will the adverse costs risk be dealt with?
•Variability – How likely are each of the above factors to change?

In principle, we work with the case materials that are available. Ideally, in order properly to assess the risk, we like to see and evaluate the following items before a decision can be taken:
•The principal documents (contracts, correspondence etc.) relied on in the case;
•Any witness statements that have been prepared;
•Any Court documents that have been filed;
•A written legal opinion dealing positively with the merits;
•A written, legally coherent justification of the quantum sought in the claim;
•A written estimate of the costs to be incurred in pursuing the claim."

I don't believe Calunius would have been prepared to fund the OXS claim to the tune of US$6.15m if they believed the chance of success was only 50/50.

I know that within a month this will be drawn to a close. One way or another. I have quite a lot invested but I am resigned to losing it all. No problem. I've already written off. Call it fatalist if you like. I look at this every day but it doesn't occupy my thoughts unhealthily. Cmon the Ox........

Wulber agreed but how much is it up the last 3 weeks ???

Naive "Very knew future" comment from the EC caused a few day spike at the beginning of the month since then down down to China town.

Binary bet now running into NOV.

Worth noting the company is valued at 28M on a 50/50 punt.

Good end to the week. Poised for continuation next week regardless of news.

Once again, rises on high volume and falls on low volume a confirmatory technical indicator.

Nik2412, hi. Only have a few minutes and obviously don't have time to read posts much and am not up to date even on the RNSs that have been released. Re 26983, if it has not been answered by others, the impression I get is that our financing situation is our problem, and the Uzbek's is theirs. It seems to me the arbitral panel tries to freeze everything in a dispute to stop one side trying to alter its cost of capital by making statements at the expense of the other party during the dispute. That would make sense if true. Robert Amsterdam told me at one AGM a few years ago that a small company can't charge its higher cost of capital (compared with a large company with a lower cost of capital). He didn't explain it like that but I asked if we could get extra compensation for that or something like that, and he said no. So I am not expecting us to get the cost of Calunius reimbursed. JMV. DYOR.

Bungee,

I reckon we'll be on for an out of hours release (pre-open or market closed) on this one so we hopefully will have a bit of time before all hell breaks loose. I wouldn't rule out some of RS other suggestions of selling on any award or a change of control in the company (where Mr Gibbons, RAB and Trident will have influence). So I'm half expecting the RNS to perhaps be more than just an arbi update. But we'll see when it comes. I cannot see an RNS of this significance being released intraday.

Regards,
Ed.
