29/10/2015 15:22 | Many thanks Nick, you're quite right. As para 13 of the notice of arbitration states, the 2010 rules apply but they're substantially identical to the 1976 rule. Para (e) is slightly different in 2010 vs 1976 but my analysis is sadly the same. These clauses have to be read in context and, as you say, (e) says "legal and other costs" which (applying the rules of construction I alluded to earlier) doesn't extent to costs of funding. I'd be delighted to be proved wrong but fear that I won't be. | wilfy75 |
