(to discover if the OCH directors will also turn out to have been negligent and/or corrupt (ref. claiming/taking massive bonus(es) from claimed large company profits as the company in fact sank...we will have to wait to see....)

...an approximation to the aims of the group are given in the header text of the thread "Action Group"..(it's been public for a good while, not secret imo)..but noting that that was written a good number of weeks ago.....and this week's version of the objectives may have some differences...

...if any shareholders are interested to join the action group..the more the merrier I think (the total shareholding of the people in the group is the biggest after the directors !)..then please visit the website (the address should be further back on this thread)...and jump through the hoops, such as showing that you are a shareholder.

Yes it is important that genuine holders give this proof. Only non- holding fakes would not be forthcoming with proof eh Markt ?

I sent a copy of a letter from Barclays Stockbrokers regarding the OCH EGM that confirmed my shareholding as 42,345 as at 30th November 2012.

It is now 19th Februaury, and still no word/reply/information/anything, and I still can't log on to this action group.

just to highlight the point that it is possible to submit a legal claim requesting that a company takes action against its directors for breaking the company act.

The OCH AG should imo consider this and see if it is possible/worthwhile at OCH.

I partly post on public msg. board as well as OCH AG website....because I want to publicise this petition under section 994 of Companies Act....to anyone reading....so that any shareholder group can be aware...and can consider the possibility of requiring a company to take legal action against its directors....

the legal finer points...I dont know....but looks like an interesting/useful lever...since the company would pay the legal costs (noting that a small legal case may be needed to force the company to take on such legal action...)

.....the number of cases of dubious/dodgy actions by directors at London Listed companies...depressing...and the lack of action from the 'system' to make any changes

(another one I've seen recently...the dirs. have made an offer to buy the company....after a long slide down in the share price ...which of course they did nothing to stop, since in their favour to buy the co. as cheapily as possible...

and at small caps. it is quite common for dirs. to de-list a co. and they pick up the shares cheap as PIs sell up as they dont want to be in an unlisted co....and no one else does either, especially if the dirs. will control the co.)

it is an interesting point imo that

at MWB/MBE the directors managed to construe for themselves complicated benefits packages....and also related party transactions...and were also significant shareholders....

ie. the same as at OCH

and at both companies ...the companies went into administration.....with allegations of wrong doing...

and at MWB/MBE legal cases have started against the board of directors...
(and in my opinion the same will happen at OCH....once organising and/or funding of legal processes can take place)

At MWB ...a large shareholder has paid to submit a case to the UK courts....but they appear to be asking that the company pays for the case....
imo the OCH action group should consider to do the same, ie. request that OCH Plc takes legal action against its bod (ie. that OCH assets are used to pay the costs).

OCH action group should imo review/monitor the process at MWB....we may be able to learn ...and to consider to take/trigger similar legal actions...

at MBE a major shareholder is taking legal action....
in the wording it looks like it is trying to get the company to take legal action ...against directors..and has submitted a legal claim to the courts..in that case the cost would imo be born by the company and not the aggrieved shareholder...

the OCH action group should look at doing the same imo...(ie. avoiding the burden of legal costs...but still putting forward a case to the courts)
