the troll - the debt will have been with Henry Homes Wallington Ltd - no reason why the parent company (Henry Homes plc) couldn't give a guarantee.

tara - unfortunately companies registered in England & Wales can't just make it up as they go along.

It's logical to assume that Nigel Henry's companies had significant inter-company dealings. It reads that the bank has appointed Receivers to Henry Homes (Wallington) LTD. This could develop into a house of cards causing the collapse of all NHs companies. At this point we don't know if OPF signed contracts directly with HH Wallingtons, now controlled by the Receiver or with Henry Homes Limited, still controlled by NH - eitherway it looks ripe for someone to start disputing contract.

If this ends up getting tested OPF could incur legal cost and extra management time to resolve.

The positive is it will be resolved with the funds OPF paid ring fenced and held separately by solicitors/escrow. OPFs current financial position is unaffected going forward so is able to complete outstanding business elsewhere.

imho shares should get to 40p near-term even with the threat of NH dumping 20% - once thats cleared could trade up to 10/15% below NAV within 12 mnths

a company can't guarantee it's own debt, if there is one ( & I don't know whether there is or not ) logic suggests it would have been written by NH himself, or a 3rd party ?

What makes you think he gave a personal guarantee? I would have thought that any guarantee would have been given by Henry Homes PLC, not personally.

Since when does the adminisitrator have any charge over OPF cash.? The land hasbeen snached back by the bank due to the fact the deal was busted on various accounts, three of which were land values falling,lack of a H/A, to buy 30% of the flats, and no one wanting the shops

Sorry, contract is now out of the window, so cash back rather fast, who has the right to hold on to it.? Not in my view the adminisitrator.

tara if the deposit is held by a third party its not going to be releashed until they know the extent of their own liabilities - there is little OPF can do apart from monitor and then commence legal action both take time and cost money.

20% being dumped on the market by a distressed seller as IMHO HBOS would demand repayment of any Guarantee from NH within 28 days - to put that into context it was kaupthing's threat of doing the same which put this stock down from 80p to 10p in the 1st place.

OPF has already stated that a wind-up would require sales completion and closure of all contract liabilities before any payments were finalised - that could be 12 - 18 months after a vote as some contracts have long stops

I don't want to be down as the news flow is positive and the share price is worth 40p at least - but its a dream world to think the NH/henry home situation is going to be settled within a week or 2 - this could rumble on for months - the administrators have not even published their initial creditors report yet

Agreed, deposit shouldnt be at risk - thought it stated in the past deposit was held by lawyers though?

Shouldn't have a great deal of overhang in a stock with limited assets (bar cash) and a wind up vote 12months from now (given the excuse? of Canon House will have been resolved)

The deposit is insured by Zurich, so there should be no worries about its recoverability.
