Yes farce is a good and appropriate description.

The non payment is as good as an admission of guilt.

I have a very good feeling about the outcome with this share. Could they get the full award on a default of 720p.

(ii) Inferences From Default
There is no question that Indonesia can afford to pay its share of the costs of these proceedings. Indonesia has failed to provide any explanation at all for its default, despite being given a number of written notices and an additional one month grace period in which payment could be made. From these facts, Churchill can only conclude that Indonesia's non payment was the result of a positive decision not to pay.


v) invite Indonesia to provide unequivocal confirmation that it is still participating in the arbitration and put Indonesia on notice that if it does not provide such confirmation by 6pm Singapore time Wednesday 20 April 2016, Churchill will bring an application under Rule 42 of the ICSID Arbitration Rules and ask the Tribunal to fix a schedule for the completion of this case without the participation of Indonesia.

Not a problem. If ICSID grant judgement in our favour then ROI overseas assets are fair game in satisfaction of same.

And I assure you from personal experience that Clifford Chance won't miss when it comes to this kind of thing.

Hold tight to your shares - it would be a shame to sell out cheap now.

Excellent news. Not necessarily the end yet, but ROI are in the brown stuff now.

And it speaks volumes re the merits of their case. Why on earth would you disrespect the people about to decide on your case by failing to pay them on time ? And why would you behave like that if you expected to win ?

Bodes well - could be about to get very interesting.
