I get the feeling that the FDA will have to thread very very carefully now and distance itself from the political agencies for fear of being being accused of "interference with due process", the process being independent from all external (and political) influence. It also appears that the FDA have fallen foul of procedural regulations as well. Odds are imho stacked in gavour of approval. Lufcs: can you post on any us/canadian bb? your post 501: exactly what I was thinking eralier today. i am not a lawyer but this would come under the postal rules governing the acceptance of offers. Could google this. I think sadly it becomes accpted once it is either posted or received by the other side ie the offeror or his agent. The fact that the offer has been received before the dealine is immterial. However, if the offer letter is being sent to the shareholders broker and not the offeror directly (ie intrexon) i wonder what the rules would be if the offeree went to the brokers offices and picked the unopened letter of acceptance having telephoned the broker ahead not to open any letter sent to them by mistake? or simply stated that on receipt of their letter it is to be returned as its been sent by mistake. Surely an offeree is allowed to change ones mind before a stated deadline. As always can be argued either way. | xcap | |

If anyone on here knows the A, then I'm sorry for doing you an injustice. Q....and this is an open Q to anyone...If one is a holder of a stock, and a bid comes in from a majority s/h(49%) and you accept the offer on the table, and subsequently within the expirery date of the offer, something happens to move the share price more than 100% in the + direction, could one cancel their decision? ie; If you held a stock and it seemed to be flatlining, then a bid/offer came in(for a circa 30% on your initial stake) and you accepted the offer. Is it set in stone, or can you change your mind through your broker before the deadline? Eg. I hold shares in x. Company z offers me a premium of 40% on my initial investment....I think...oooh ok, I accept....then there is some drastic change in the fortunes of x. Oh, I've(Ihavn't) accepted the mandatory offer from z, with an expirey date of 4th Jan 2013. Can a shareholder inform their broker and cancel/alter their initial decision before the deadline?
